TERMS & CONDITIONS

Conditions of entry

1. This competition is open to all residents of the United Kingdom, except employees of Eurostar Group Limited and Eurostar (U.K.) Limited (together referred to as “Eurostar”), and their associated, affiliated or subsidiary companies, and their immediate families, agents, or anyone connected with this competition, including third party promotional partners.
2. The competition commences on 9^th November 2009 at 09.00 am GMT. The closing date for entries is 12.00 mid-day GMT on Thursday 12^th November 2009. All entries must be received before the closing date. Late entries will not be taken into consideration in the selection of each winner.
3. By entering the competition, entrants are deemed to have read, understood and accepted all of the Terms and Conditions of the competition and agreed to be bound by them.
4. Entrants must be aged 18 or above at the time of entry.
5. All entries become the property of Eurostar and cannot be returned.  Eurostar reserves the right in its sole discretion to disqualify any individual who Eurostar has reason to believe has breached any of the competition Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the promotion.  Eurostar’s legal rights to recover damages or other compensation are reserved. Eurostar reserves the right to amend these Terms and Conditions. Any amendments will be published through www.eurostar.com and directly on www.littlebreakbigdifference.com.
6. Entrants  may enter this competition as many times as they wish.
7. No purchase necessary.  The competition is free to enter.  Entrants can enter by registering through www.eurostar.com at www.littlebreakbigdifference.com and completing the online entry form.  To enter the competition, entrants will need to provide the following information:

(a)    contact details (i.e., full name, mobile telephone number & email address); and

(b)    the entrant’s response to the single competition question (up to a maximum of 25 words).

1. Following submission of the entry form, entrants will receive an on screen confirmation that they have applied to enter the competition.  Alternatively, entrants can enter the competition by sending the entry form or all required entry details attached on a separate sheet of paper to Eurostar’s 15^th Birthday Invitation, 137 Ember Lane, Esher, Surrey KT10 8EH.

1. All the information set out in paragraph 7 above must be submitted along with the entry form in order for the entry to be accepted.

1. All winners may be required to take part in any publicity accompanying or resulting from this competition.

1. By entering this competition, all entrants grant Eurostar and its agents, the right to use their names, photographs, likeness and the right to adapt, publish or use their entries for any advertising, promotional, trade or any other purpose without compensation or permission from the entrant (“the Images”).  You acknowledge and you agree that the Images may be combined with other images, text and graphics and cropped, altered or modified. You  further acknowledge and agree that all rights, including all intellectual property rights, in the Images produced by you or Eurostar shall vest in Eurostar worldwide and for their duration and Eurostar shall be entitled to assign, license and/or exploit the Images as Eurostar, in its absolute discretion, shall elect without paying any fee to you.

1. Eurostar is not responsible, and shall not be liable, for any problems related to any telephone network lines, computer online systems or equipment, software failure of any email or failure of an entry to be received on account of technical problems or traffic congestion on the internet, telephone lines, www.eurostar.com or www.littlebreakbigdifference.com. No entries will be accepted in bulk, from agents or third parties.

1. Subject to paragraph 15, entrants agree to release Eurostar and its agents from any and all liability, damages, or loss incurred as a result of acceptance, awarding, receipt, possession, use and/or misuse of any prize awarded in this competition. Eurostar will not be liable for the loss or damage arising out of the winners’ or their guests’ enjoyment of the prizes.

1. Eurostar reserves the right, in its sole discretion, to modify, suspend or cancel the online entry route should virus, bugs, tampering, fraud or other causes beyond the control of Eurostar corrupt the administration or security of the competition.

1. Nothing in these Terms and Conditions shall exclude Eurostar’s liability for (i) death or personal injury as a result of its negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be limited or excluded by law.

1. Eurostar reserves the right in its absolute discretion to disqualify any entrant or entry which does not comply with these Terms and Conditions and/or any entrant whose conduct is contrary to the spirit of these Terms and Conditions.  In the event of circumstances beyond its reasonable control, Eurostar reserves the right to withdraw, amend or cancel this competition. Eurostar reserves the right to substitute a prize of equal value in the event that circumstances beyond its control make this unavoidable.

1. The winners may be required to submit valid identification before receiving their prize.

1. The winners are responsible for ensuring that they are able to accept the prize(s) as set out and in accordance with these Terms and Conditions, in the event that they are unable to do so, Eurostar reserves the right the withdraw the prize.

1. Other than as expressly set out in these Terms and Conditions, the prizes do not include any other incidentals including, but not limited to, drinks, mini-bars, telephone calls, travel insurance, accommodation and the cost of transportation to and from St Pancras International Station and at the destination. These are the responsibility of the winners.

1. Eurostar Conditions of Carriage apply to all Eurostar travel, copies of which may be obtained by writing to Eurostar UK Sales, Times House, Bravingtons Walk, London N1 9AW or via the website www.eurostar.com.

1. Eurostar shall not be responsible for any indirect, special or consequential damages or losses suffered by the winners, any entrant or a third party.

1. The winners and their chosen companions must comply with all relevant customs, security and immigration requirements, including appropriate passport and visa requirements. Eurostar will not be liable for any passenger’s failure to comply with these requirements. The winners and their guests are responsible for their own travel insurance arrangements.

1. There is no cash or other alternative to the prizes, and the prizes are not transferable and no part or parts of the prizes may be substituted for other benefits, items or additions.

1. Subject to paragraph 11, the personal details supplied by entrants will not be disclosed to other parties or used in any other way for marketing purposes unless they have opted in to receive further information from Eurostar.

1. If any of the provisions of these Terms and Conditions are held to be invalid or unenforceable in whole or in part that part shall be severed from the remainder of the provisions and the validity of the other provisions and the remainder of the provision in question shall not be affected.

1. For a list of winner please send a stamped self addressed envelope to Eurostar’s 15^th Birthday Invitation, 137 Ember Lane, Esher, Surrey KT10 8EH, stating for which competition you would like the winner’s details.

1. These Terms and Conditions shall be governed by the laws of England and Wales and any dispute shall be subject to the exclusive jurisdiction of the English court.

Use of your data

By disclosing personal information to us, you agree that we may obtain, hold and use any personal information you submit to us for the purposes of processing your entry and administering the competition and if you indicate your acceptance during the entry process (for example, by appropriately marking the relevant box(es) provided) for marketing our other products and services to you.

Winners and prizes

15^th Birthday Celebrations at St Pancras International Station on Friday 13 November 2009

1. There are a total of 30 prizes to win an invitation to Eurostar 15^th birthday celebration at St Pancras International Station on Friday 13 November 2009. Winners will be selected at random from all valid on-line competition entries by Eurostar’s Sales & Marketing Director, Emma Harris.  Her decision will remain final and no correspondence will be entered into.
2. Each winner will be contacted by phone between 6pm – 9pm GMT on Thursday 12^th November, 2009, using the mobile phone number provided as part of each entrant’s completed entry form.  A total of three attempts to contact each winner will be made between these hours.  If no contact with any selected winner is possible in this period, the entry will be declared null and void and a replacement entry will be drawn.  The process will be repeated until a total of 30 winners have been selected, contacted, advised of all invitation conditions (see below) and Eurostar has been assured of each winner’s availability and willingness to attend.
3. If any selected winner and their selected partner are unable to attend the birthday event at St Pancras International Station on 13 November 2009 or comply with any of the other conditions set out in paragraph 5 below, the conditions of entry will be deemed to have been broken and their entry will be declared null & void and the replacement selection process detailed in paragraph 2 above will be implemented.
4. Each of the 30 confirmed winners will receive an invitation for them and a partner to attend Eurostar’s 15^th birthday celebrations to be held in the Searcy’s Champagne Bar at St Pancras International Station on Friday 13^th November 2009 between 5.00pm and 7.30pm GMT.  They will be joined at the event by the 20 winners (and partners) selected via separate radio competitions.  During Eurostar’s 15^th birthday celebrations, all 50 winners will be automatically entered into a free prize draw to be hosted by the -acclaimed chef, Albert Roux, for the chance to join Eurostar on the ultimate weekend in Paris, specific terms and conditions of which are detailed below.
5. The Conditions for Eurostar’s 15^th birthday celebration prizes are that winners and their partner must:

(a)    meet underneath The Meeting Place statue on the main concourse at St Pancras International station and register themselves with Eurostar competition staff at 5pm GMT on Friday 13 November 2009;

(b)    be available to attend the birthday celebrations in the Searcy’s Champagne Bar at St Pancras International station between 5.00pm and  7.30pm GMT on 13 November 2009;

(c)     be able to travel from London St Pancras International station to Paris Gare Du Nord that same evening, returning to St Pancras International Station on the 2.15pm GMT Eurostar train service from Paris Gare Du Nord on Sunday 15^th November 2009; and

(d)    arrive with suitable luggage/clothing for the ultimate weekend in Paris, full details of which will be advised to all winners via phone and email correspondence in advance of their arrival at St Pancras International on 13 November 2009.

The ultimate Paris weekend

1. There are a total of 15 prizes to win tickets to the ultimate weekend in Paris (“Paris Weekend Prize”). Each winner may take one companion with them on the ultimate weekend in Paris. The winners of the Paris Weekend Prizes will be selected at random from the winners of Eurostar’s 15^th Birthday celebrations held at St Pancras International Station on Friday 13 November 2009.
2. All winners must have adhered to all the Terms and Conditions of the competition.  If, for any reason, this is not the case, then Eurostar has the right to offer the prize to another person.
3. Each Paris Weekend Prize consists of:

-            a return journey on the Eurostar train service in Leisure Select for two (2) persons to Paris Gare Du Nord, leaving St Pancras International Station at 7.32pm on 13 November 2009 and returning on the 2.15pm Eurostar train service on 15 November 2009 from Paris Gare Du Nord

-            Two (2) nights’ double room, hotel accommodation, staying at the Pullman Hotel Rive Gauche in Paris

-            Breakfast for two at the Pullman Hotel Rive Gauche on the morning of Saturday 14 November 2009 only

-            a Pastry/dessert course master class for two, hosted by award-winning French chefs (all English-speaking), to be held between 10am – 12 mid-day on Saturday 14 November

-            a 10% discount shopping voucher for Galleries Lafayette

-            Full evening’s entertainment for two on Saturday 14 November 2009 including a VIP tour of the Eiffel Tower, Seine river cruise dinner and tickets to the night’s final show at The Lido.  Dinner will comprise a glass of champagne, 3-course menu (vegetarian option also available upon request) and one bottle of wine per couple whilst winners will be entitled to receive a glass of champagne to accompany their viewing of the night’s final show at The Lido

-            Sunday breakfast for two at Angelina’s (226 Rue de Rivoli) to a value of €20 per person

-            Use of Eurostar’s Business Lounge at Paris Gare Du Nord for the return journey on 15 November 2009

-            Luxury air-conditioned coach transfers (from arrival at Paris Gare Du Nord to the Pullman Hotel Rive Gauche on the evening of Friday 13 November; from the Pullman Hotel to the pastry/dessert course masterclass, from the masterclass to Galleries Lafayette, from the Pullman Hotel to the Eiffel Tower, from the Eiffel Tower to Bateaux Parisiens, from Bateaux Parisiens to The Lido and from The Lido back to the Pullman Hotel, all on Saturday 14 November; and from the Pullman Hotel Rive Gauche to Paris Gare Du Nord on Sunday 15 November

-            A complimentary glass of house champagne each at the Searcy’s Champagne Bar upon your return to St Pancras International station on 15 November 2009.

4.         Where necessary, due to factors outside Eurostar’s full control, Eurostar reserves the right to change details of the Paris Weekend Prize but will use its reasonable endeavours to keep changes to a minimum.  (For instance, if one of the planned tours becomes unavailable for any reason, Eurostar may substitute an alternative tour or activity.  By way of another example, Eurostar may place you on earlier or later trains than those previously indicated if necessary due to delays or train cancellations.)

5.      To the extent that the Paris Weekend Prize involves tours or other activities provided by third parties, those activities are subject to, and you agree to comply with, any applicable terms and conditions stipulated by the relevant supplier.

6.      As a condition of taking the prize, the winners must ensure that their chosen companion is prepared to accept the companion conditions attached in Schedule 1.

7.         Winners of the Paris Weekend Prize and their companions will be required to take part in any publicity accompanying or resulting from this competition.  In addition, all winners will be required to allow Eurostar to copy and reproduce all video footage shot throughout the weekend using the Sony video cameras provided, to be used for Eurostar’s own marketing purposes in accordance with the rights you grant Eurostar for the use of the Images.  In addition, winners will be required to contribute to a blog of the weekend, full details of which will be advised to them during the course of the weekend in Paris and hereby grant Eurostar by way of present and future assignment a worldwide, royalty free, license in perpetuity for Eurostar to use and exploit the blog entry.

8.      No cash or other alternative prizes are available unless otherwise agreed in writing by Eurostar.

Schedule 1

Companion Conditions

These terms apply to all persons accompanying the winners of the “Ultimate Paris Weekend” planned to depart London on 13 November 2009.  They are supplementary to, and act as a specific variation to, the Special Conditions of Carriage Relating to Passengers applicable to the tickets of all participants.  By participating in the “Ultimate Paris Weekend” day trip you agree to be bound by these terms, including as to any use of your image and/or name as set out below. This applies whether or not you sign and return the document for our records.

In this document the word “Eurostar” refers to Eurostar (U.K.) Limited, Eurostar Group Limited.

1. Where necessary, due to factors outside Eurostar’s full control, Eurostar reserves the right to change details of the Activity but will use its reasonable endeavours to keep changes to a minimum.  (For instance, if one of the planned tours becomes unavailable for any reason, Eurostar may substitute an alternative tour or activity.  By way of another example, Eurostar may place you on earlier or later trains than those previously indicated if necessary due to delays or train cancellations.)

1. To the extent that the Activity involves tours or other activities provided by third parties, those activities are subject to, and you agree to comply with, any applicable terms and conditions stipulated by the relevant supplier.

1. You understand and have considered and evaluated the nature, scope and extent of the risks involved in the Activity, and has voluntarily and freely chosen to participate entirely at their own risk.  Eurostar accepts no liability for any loss or liability of any kind in contract, tort or otherwise howsoever arising out of your participation in the Activity.
